TErms and conditions



1. Rental Party.
The rental party shall consist of the number adults and children specified when making your reservation (including the Guest, the “Rental Party”).

2. Rental Term.
The rental term begins at 3:00 p.m. on the arrival date specified when making your reservation and ends at 10:00 a.m. on the departure date specified when making your reservation (the “Lease Term”).

3. Rental Policies.
At all times during the Lease Term, you agree to abide by, and to cause all members of the Rental Party (and any other persons granted access to the Property during the Lease Term) to abide by the instructions of LCV Bookings, Ltd. and its affiliated entities (“Luxury Cayman Villas”), the laws of the Cayman Islands, and the following rental policies:

3.1 Check-In Time.
Check-in time is 3:00 p.m. local time. Luxury Cayman Villas will contact you before your arrival to request your flight details so we know when to expect you. If you are arriving earlier than 4:00 pm local time, you may request an early check-in to extend the Lease Term, subject to confirmation from Luxury Cayman Villas.

3.2 Check-Out Time.
Check-out time is 10:00 a.m. local time and may be strictly enforced. If you are departing later in the day, you may request a late check-out to extend the Lease Term, subject to confirmation from Luxury Cayman Villas. Should any member of the Rental Party depart after the confirmed check-out time, you agree to pay and authorize Luxury Cayman Villas to charge the credit card on file for a late check-out fee equal to (i) 50% of one night’s stay, provided all departures are completed by 2:00 pm local time, or (ii) one night’s stay if any departures are completed after 2:00 pm local time.

3.3 Amenities and Sundry Items.
We offer complimentary bath amenities in each bathroom, including shampoo, conditioner, soap and lotion. Toilet paper, paper towels, bath soaps, hand soaps, dishwashing detergent and laundry detergent are also provided for you at the beginning of your stay.

3.4 Coffee and Tea Bar.
Nespresso and Keurig machines are provided along with a supply of coffee pods and a selection of teas at the beginning of your stay. Some properties may also offer a drip coffee and/or espresso maker that can be used with ground beans. Additional coffee and tea supplies, if desired, can be readily purchased on island.

3.5 Wi-Fi.
Complimentary, unlimited Wi-Fi is included with your stay. Simply sign onto our network using the information provided in the guidebook provided at the Property.

3.6 Baby Amenities.
A complimentary pack ‘n play, highchair, baby monitor, and/or baby proofing kit can be provided at your request. Cribs, baby gates and additional baby gear can be rented for an additional fee.

3.7 Smoking.
Smoking is not allowed inside the Property under any circumstances, although smoking is permitted outside. Please dispose of any cigars and cigarettes properly. You agree to pay and authorize Luxury Cayman Villas to charge the credit card on file for the costs of any cleaning or other remedial action required to rectify any damage, odor or other harm caused by smoking at the Property.

3.8 Outdoor Fires.
ursuant to the laws of the Cayman Islands, please note that outdoor fires are not allowed.

3.9 Fishing and Catching.
Please note that fishing and the catching of marine life is heavily regulated in the Cayman Islands. Violation of these laws carries a penalty of up to CI$500,000 and four years in jail. Prior to conducting any of these activities, we recommend you review the marine park regulations carefully at http://doe.ky/conservation-law/marine-park-regulations-maps-and-conservation-laws/.

3.10 Watersports Equipment.
Please securely store all snorkeling, scuba, fishing gear or other watersports equipment outside the Property. Please remember that, with changing tides, sea levels may vary considerably throughout the day. We recommend you pull any watersports equipment left outdoors all the way up or off the beach at the Property to prevent loss.

3.11 Beach and Water Entry.
The beaches and water entries around the island of Grand Cayman may vary throughout the year due to circumstances beyond our control, including erosion, storm activity and other naturally occurring phenomena. No discounts or refunds are given if the beach or water entry at the Property varies from the images on our website or the Rental Party’s expectations.

Beaches throughout the Caribbean, including along the island of Grand Cayman, may also experience an accumulation of sargassum from time to time. Sargassum is a generally harmless seagrass that is more unsightly than anything else and that offers a valuable turtle nesting ground. Although sargassum accumulation may occur at any time, the condition is largely seasonal and tends to be most apparent in late summer months. Fortunately, Grand Cayman does not ordinarily see the extraordinary accumulations that can plague other Caribbean destinations from time to time.

Please note that the beach at the Property will be thoroughly raked prior to your arrival. Accordingly, the majority of Luxury Cayman Villas guests never experience sargassum. Should you nevertheless encounter undue accumulation during your stay, please contact Luxury Cayman Villas for suggestions for unaffected beaches.

3.12 Pool Cleaning.
Pools are cleaned at least weekly during your stay for your comfort and convenience.

POOLS AND OCEANS ARE INHERENTLY DANGEROUS. PLEASE SUPERVISE CHILDREN AT ALL TIMES. THERE ARE NO BARRIERS OR CHILD SAFETY DEVICES AROUND THE POOL, SPA OR OCEAN.

3.13 Water and Power.

Tap water in the Cayman Islands is desalinated sea water and is safe to drink. Please note that the water desalination process and the production of electricity on island have a significant adverse impact on the precious local marine environment. Although water and electricity are included in your stay, please conserve accordingly, including by keeping doors and windows shut while the air conditioner is running.

3.14 Housekeeping.
Unless you are advised otherwise in writing by Luxury Cayman Villas prior to your execution of this Agreement, one mid-week housekeeping with two housekeepers for up to two hours or one housekeeper for up to four hours is included with your stay. Daily housekeeping service can be arranged for an additional fee. Towels, linens, and robes may not be removed from the Property. Should you wish to purchase these items to take home with you, please contact Luxury Cayman Villas.

3.15 Pets.
Pets are not allowed without prior written permission (which may be withheld in the sole discretion of Luxury Cayman Villas) and are subject in all cases to a refundable cash pet deposit based on the size and nature of the pet. Please note that the process for importing animals into the Cayman Islands is a lengthy one, and you will need to start planning at least six months prior to your arrival. 3.16 Visitors.
Any persons who are granted access to the Property during your stay are your sole responsibility. No persons other than those in the registered Rental Party may stay overnight at the Property. You agree to alert Luxury Cayman Villas to any external vendors who may be providing services at, or otherwise visiting, the Property. For your safety, Luxury Cayman Villas reserves the right to deny entry to any vendors that it believes may be unsuitable in its reasonable discretion.

3.17 Weddings and Events.
Weddings and events are not allowed at the Property without prior written permission (which may be withheld in the sole discretion of Luxury Cayman Villas) and are subject in all cases to the additional fees, terms and conditions in the Luxury Cayman Villas Wedding Event Policies, available at https://goo.gl/jmasbm.

3.18 Reasonable Access.
The Guest shall allow the Property Owner and Luxury Cayman Villas reasonable access to the Property for purposes of repair, cleaning, or inspection.

4. Rental Rate and Fees.
The Guest agrees to pay the applicable rental rate, fees and taxes (the “Rental Charges”) set forth in the Rental Rate Details and Booking Charges sections of this Agreement, which are incorporated herein by reference.

5. Payment.
The Guest agrees to issue prompt payment for all Rental Charges in strict accordance with the Payment Schedule section of this Agreement, which is incorporated herein by reference. The Property Owner reserves the right to terminate this Agreement and/or cancel this reservation without refund of any prior deposits if any scheduled payment is not made promptly.

6. Changes and Cancelations.
6.1 Festive Week Reservations. Any reservation that includes any day during the calendar week of Christmas Eve, Christmas Day, New Year’s Eve or New Year’s Day (a “Festive Week Reservation”) is non refundable.   The deposit received at booking and the balance which is due 60 days from arrival are 100% non refundable.  No changes or cancellations at any time will be refunded.                               

6.2 All Other Reservations.
Any reservation other than a Festive Week The 50% deposit due at booking is refundable up to 60 days before arrival, less the administrative fee.   The balance is due 60 days before arrival, at which time the booking is 100% non-changeable and non-refundable.                                                                                                                              

7. Force Majeure.
Neither the Property Owner nor Luxury Cayman Villas shall be liable for any circumstances beyond their control, including, but not limited to, acts of god, acts of governmental agencies, fire, strikes or labor shortages, wars, floods, storms, pandemics or epidemics, inclement weather, or any other events or circumstances not within the reasonable control of the Property Owner or Luxury Cayman Villas, whether similar or dissimilar to any of the foregoing (“Force Majeure Event”). In the unlikely event that the Property becomes untenantable, unavailable or otherwise unsuitable for occupation as a result of a Force Majeure Event as determined in the sole and absolute discretion of Luxury Cayman Villas, the following applies.

7.1 Force Majeure Event After the Arrival Date.
The Property Owner and Luxury Cayman Villas will attempt to relocate the Rental Party to similar or better accommodations. Luxury Cayman Villas maintains strong relationships with other on-island accommodations providers, managers, owners, and rental agents, as well as the Cayman Islands Department of Tourism. Should acceptable accommodations not be available, however, the aggregate liability of the Property Owner and Luxury Cayman Villas shall be limited to the Guest’s choice of either a prompt refund of all unearned Rental Charges paid, or a future stay at the Property of equal or lesser value of all unearned Rental Charges paid, subject always to availability.

7.2 Force Majeure Event Prior to the Arrival Date.
Unless otherwise refundable pursuant the Changes and Cancellations provision above, neither the Property Owner nor Luxury Cayman Villas shall be obligated to offer a refund as a result of a Force Majeure Event. That being said, if such a reservation is changed or canceled as a result of a Force Majeure Event, any amounts previously paid may be applied toward another rental in the same Property within one year of the original arrival date. Should Luxury Cayman Villas determine in its reasonable directions that the Property will likely remain unavailable for more than one year from the original arrival date or should the Property actually remain unavailable for more than one year from the arrival date, Luxury Cayman Villas shall issue a prompt refund of all unearned Rental Charges paid. The aggregate liability of the Property Owner and Luxury Cayman Villas shall never exceed the unearned Rental Charges paid.

8. Hurricane Guarantee.
Notwithstanding anything herein to the contrary, if the Cayman Islands Government orders a mandatory evacuation due to a tropical storm or hurricane in the area where Property is located and the Rental Party must evacuate the Property during their stay, the Property Owner will refund in full the portion of the Rental Charges attributable to the dates of stay impacted by the evacuation order.9. Due Care. The Guest agrees to cause all members of the Rental Party (and any other persons granted access to the Property during the Lease Term) to keep the Property and all furnishings, fixtures, fittings or other items in or about the Property in good order, using them at all times only for their intended purposes. All refuse must be disposed of properly in the appropriate receptacles located at the Property.

The Guest shall not permit any member of the Rental Party (or any other persons granted access to the Property during the Lease Term) to negligently or willfully damage or otherwise harm the Property or anything in or about it, ordinary wear and tear excepted. The Guest agrees to be financially responsible for any and all damage or harm to the Property or anything in or about it.10. Security Deposit and Vacation Rental Damage Protection Policy. Unless otherwise indicated, the Guest agrees to either (i) secure a vacation rental damage protection policy reasonably acceptable to the Property Owner and Luxury Cayman Villas that covers accidental damage to the Property in the amount of at least US$5,000.00 or (ii) provide a US$5,000.00 security deposit in cash prior to check-in.

THE GUEST HEREBY EXPLICITLY AUTHORIZES PROPERTY OWNER AND LUXURY CAYMAN VILLAS TO WITHHOLD FROM THE SECURITY DEPOSIT, RECOVER FROM THE VACATION RENTAL DAMAGE PROTECTION POLICY, AND/OR CHARGE THE CREDIT CARD ON FILE FOR THE FULL REPAIR OR REPLACEMENT COST OF ANY AND ALL DAMAGE OR OTHER HARM ACCIDENTALLY, NEGLIGENTLY OR WILLFULLY DONE TO THE PROPERTY OR ANYTHING ON OR WITHIN IT DURING THE LEASE TERM, AS DETERMINED IN THE REASONABLE DISCRETION OF LUXURY CAYMAN VILLAS.

Luxury Cayman Villas shall provide documentation to support any such repair or replacement cost, if requested, and the Guest agrees not to contest or dispute any such documented claims, withholdings or charges.

You may purchase a vacation rental damage protection policy directly through Luxury Cayman Villas. If purchased, the policy will pay a maximum benefit of US$5,000.00 for any covered damage. If an insured person causes any covered damage during your stay to any real or personal property comprising the Property as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of US$5,000.00. Certain terms and conditions apply. Please read your Description of Coverage or Insurance Policy carefully, and contact CSA at (866) 999-4018 with any coverage questions.

The vacation rental damage protection policy can be purchased up to and including at the time of check-in. By submitting payment for this policy, you authorize and request CSA Travel Protection and Insurance Services to pay directly LCV Bookings, Ltd., any amount payable under the terms and conditions of the Vacation Rental Damage, and authorize LCV Bookings, Ltd. to be your attorney-in-fact to act on your behalf with respect to any and all matters related to claims made under the policy. Please contact LCV Bookings, Ltd., if you do not wish to participate in this assignment.

11. Travel Insurance.
PLEASE CONSIDER PURCHASING TRAVEL INSURANCE. Except in the specific circumstances described above, your reservation is non-refundable and our cancelation policy may be strictly enforced. Travel Insurance is available from Luxury Cayman Villas with your reservation. This Travel Insurance provides coverage for prepaid, non-refundable expenses incurred due to certain unforeseeable circumstances that may jeopardize your vacation investment. Certain terms and conditions apply. Full details of the Travel Insurance coverage are contained in the Description of Coverage or Insurance Policy, available at http://www.csatravelprotection.com/certpolicy.do?product=G-330CSA. Please read your Description of Coverage or Insurance Policy carefully, and contact CSA at (866) 999-4018 with any coverage questions.

12. Limitation and Waiver of Liability.
The Guest agrees that neither the Property Owner nor Luxury Cayman Villas is responsible for, and the Guest expressly assumes the risk of, any accidents, injuries, illness or other harm that befalls any member of the Rental Party (or any other persons granted access to the Property during the Lease Term), as well as any loss of personal belongings or valuables during the Lease Term. The amenities, sundry items, coffee and tea bars, internet access, baby amenities, and watersports equipment (if any) described herein, as well as any other specific features or amenities typically available at the Property, are provided at the discretion of the Property Owner for the convenience and enjoyment of the Rental Party, but do not form an integral part of this Agreement. Neither the Property Owner nor Luxury Cayman Villas shall bear any responsibility should such features or amenities be unavailable for some or all of your stay.

13. Fraud, Misrepresentation, or Violation.
In the event that this reservation has been obtained under false pretenses, or in the event the Guest or the Rental Party (or any other persons granted access to the Property during the Lease Term) violates any term of this Agreement, the Property Owner shall have the right to deny check-in or evict the Rental Party without refund. The Guest agrees to save, indemnify and hold harmless the Property Owner and Luxury Cayman Villas from and against any and all losses directly or indirectly attributable to any such false pretenses or violations.

14. Data Privacy.
The Guest, on his or her own behalf and on behalf of each member of the Rental Party, agrees to the terms and conditions contained in the Luxury Cayman Villas Privacy Policy, available at https://www.luxurycaymanvillas.com/
privacy-policy/
, which is incorporated by reference herein.

15. Governing Law, Jurisdiction and Venue.
This Agreement shall be governed by and construed in accordance with the laws of the Cayman Islands.

16. Dispute Resolution.
The Guest, on his or her own behalf and on behalf of each member of the Rental Party, agrees that any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be submitted to the exclusive jurisdiction and venue of the courts of the Cayman Islands. The Guest, on his or her own behalf and on behalf of each member of the Rental Party, specifically agrees not to dispute or otherwise initiate a chargeback of any payments or deposits processed via credit card if such payments or deposits arise out of or relate to any claimed payment obligation due under this Agreement and whether or not such payment obligation is in dispute. The Guest, on his or her own behalf and on behalf of each member of the Rental Party, further agrees to instead resolve any such dispute in a court of competent jurisdiction in the Cayman Islands. If the Guest or any member of the Rental party successfully disputes or otherwise initiates a chargeback of any payments or deposits processed via credit card which relate to any claimed payment obligation due under this Agreement in violation of this provision, it is expressly agreed that the Guest shall be liable to Luxury Cayman Villas for the amount of any such chargeback and that all defenses as to the validity of the charges in question are waived in any subsequent legal proceeding. If any legal action or proceeding is commenced to construe or enforce this Agreement in a court of competent jurisdiction in the Cayman Islands, then the party prevailing in that action, and any appeal thereof, shall be entitled to recover its attorneys’ fees and costs in that action or proceeding, as well as all costs and fees of any appeal or action to enforce any judgment entered therein.  

17. Interpretation.
In this Agreement, references to the parties include their personal representatives, permitted assignees, and/or respective successors to substantially the whole of their respective undertakings hereunder; where any party comprises more than one person, the obligations and liabilities of that party under this Agreement shall be joint and not several obligations and liabilities of those persons; words importing persons of one gender shall include persons of any other, and words importing the singular number shall include the plural and vice versa; words importing persons include companies, associations or bodies of persons, whether or not incorporated; headings are for convenience only and shall not affect the construction of this Agreement; and signatures submitted by facsimile, email via portable document format (pdf), or other electronic means are binding and shall be considered to be original signatures.18. Supersedes Previous Agreements. This Agreement constitutes the entire agreement and understanding between the parties to this Agreement and supersedes all prior and contemporaneous negotiations and understandings between the parties whether oral or written, expressed or implied.By acknowledging this document and/or sending a deposit to hold a reservation, the Guest agrees to all terms and conditions of this Agreement on his or her own behalf and on behalf of each member of the Rental Party, as evidenced by the signature set forth below. The Guest further represents and agrees that he or she (i) is at least twenty-four years of age, (ii) will be the principal responsible person for the Rental Party under this Agreement and during the Lease Term, (iii) has the authority to act on behalf of each member of the Rental Party, and (iv) will be responsible for, and save the actions of all others in the Rental Party, for whom he or she may be making these arrangements. If signed by an agent of the Guest and the Rental Party, the agent represents that he or she has the authority to sign on the Guest and Rental Party’s behalf.This Vacation Rental Agreement (the “Agreement”) is made by and between you (“you” or the “Guest”) and the record owner (the “Property Owner”) of that certain real property being reserved (the “Property”).
